LoonyLearn.com is a website that is intended to provide fun and educational games for kids to use under the guidance of their parents and teachers. We recognize that visitors to our site will include children younger than the age of 13 (“Children”). As required by The Children’s Online Privacy Protection Act (“COPPA"), we provide this privacy policy to inform parents and legal guardians (collectively, “Parents”) and other site users about our privacy practices.

This privacy policy explains our privacy practices for www.LoonyLearn.com and any other website, mobile application, or other interactive features or downloads that are operated by LoonyLearn.com (“LoonyLearn") and that link to this privacy policy (the “Site”). This privacy policy only covers information collected at the site and does not cover information collected offline by LoonyLearn (unless specifically stated) nor does it apply to any of our mobile apps that do not link to this privacy policy.

The site does not require children to provide their name, address, or other contact information in order to play the games on the site. The site, and its third party service and content providers, may collect IP address and similar device identifiers –– but only for analytical and other internal-operations purposes — by means of cookies, beacons and other technologies.

The site does collect personal information from parents, teachers, and other adults when such adult subscribes to a paid account on the site.

In order to keep the site free for non-subscribers, we may have advertisements on the site. We work with ad companies to facilitate the placement of these advertisements. However, we use only contextual-advertising methods and not interest-based (a/k/a “online behavioral”) advertising methods.

INFORMATION THE SITE COLLECTS

Personal Information

“Personal Information” is information that could reasonably be used to contact you or to identify you personally (for example, first and last name, mailing address, email address, or telephone number). The site does not generally collect name, address, or other contact information from children, other than the limited circumstances set forth below. However, we and our third-party service and content providers may collect IP address or other unique identifier (“Device Identifier”) that is associated, on a persistent or on-going basis, with the computer, mobile phone or other device used to access the site, and which is considered personal information for children. We, and our third-party service and content providers, use Device Identifier information solely to support internal operations, including maintaining, securing, and analyzing the functioning of the site and serving contextual advertisements.

The site may also, on limited occasions, collect first name and online contact information (typically, an e-mail address) of Children solely for the following purposes:

For one-time use of that information, such as to respond directly to a specific request (for example, answering a question submitted through the site). We delete the contact information provided from our records once it is used to fulfill the specific one-time purpose and will not use it to re-contact the child; OR

For the sole purpose of any of the following: to protect the security or integrity of the site; to take precautions against liability; to respond to judicial process; and, to the extent permitted under other provisions of law, to provide information to law enforcement agencies or for an investigation on a matter related to public safety; OR

Company only collects limited Personal Information about children ("Children's Personal Information") directly from the parent or guardian who has downloaded our mobile applications or registered on our website. If you are a minor, please do not send any Children's Personal Information about yourself to us, other than what we request from your parent or guardian who registers for the services.

In the event that we learn that we have collected Children's Personal Information directly from a minor, we will delete that information as quickly as possible. If you believe that a minor may have provided us Children's Personal Information without parental involvement, please contact us at compliance@loonylearn.com.

If the site offers a feature that collects a Child’s Personal Information in addition to the information described above, LoonyLearn Network will provide the child’s parent prior notice of the site’s privacy practices and obtain the parent’s consent to the collection of the Child’s Personal Information.

Please note that, as required by law, we will not condition a child’s participation in an activity on the site on the child’s disclosing more than is reasonably necessary to participate in such activity. We use Personal Information only for the purpose that it was provided and for internal purposes.

If you are a minor and your parent has signed up for the Service, you understand that your parent may be able to view all information within or associated with the account, including without limitation progress reports and usage data that tracks your performance on games, assessments and other tests available through the Services.

In some cases, we will collect Personal Information from a parent, teacher, or other adult, such as in connection with his or her registration for a paid subscription with the Site, which requires payment via a payment card. We will use Personal Information collected from adults to process the transaction and provide our products and services as applicable; to provide information, products, or services that we believe will interest you or you have agreed to receive, including information and special offers from us and our third-party business partners; to contact you regarding your account or your use of the site and, in our discretion, changes to Site policies; to improve the site, our products and services, and for our internal business purposes; and for other purposes as disclosed at the time you provide your information, with your consent, and as further described in this Privacy Policy.

Other Information

In addition, we and our third-party service providers, including any third-party content providers, may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the site (“Usage Information"). Usage Information may include the browser and operating system you are using, the URL or advertisement that referred you to our site, the search terms you entered into a search engine that lead you to our site (if applicable), all of the areas within our site that you visit, and the time of day, among other information. We may use Usage Information for a variety of purposes, including enhancing or otherwise improving the site and our products and services.

Cookies and Similar Technologies

We, and our content and service providers, may use the following technologies to collect Usage Information and Device Identifier:

Cookies. A cookie is a data file placed on your computer or other device when you visit the site or otherwise access our online content. Cookies may be used for many purposes, such as supporting game play and for analytics and similar internal purposes. Web Beacons. When you visit the site, we or our third party service providers (such as advertising companies, advertisers and analytics companies) may set web beacons (small graphic images or other web programming code, also known as “1×1 GIFs" or “clear GIFs") and similar technologies on our site. Web beacons can recognize certain types of information on your computer such as cookies, the time and date a page is viewed, and a description of the page where the web beacon is placed. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the site, and to improve your experience on the Site.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the site, such as the links you click on. The code is temporarily downloaded onto your device from our web server or a third-party service provider, is active only while you are connected to the site, and is deactivated or deleted thereafter.

DISCLOSURE OF COLLECTED INFORMATION

Children

LoonyLearn does not disclose Children’s Personal Information to third parties, except with regard to the safety and security of the site as discussed above, and to service providers who provide support for the internal operations of the site and who do not disclose or use the Personal Information for any other purpose. These service providers may provide support services such as hosting the site, designing and/or operating the Site’s features, or performing other administrative services. LoonyLearn may provide these companies with access to Children’s Personal Information in order for them to carry out the services they are performing on LoonyLearn’s behalf. These service providers have agreed to maintain the confidentiality, security and integrity of this Personal Information they obtain from LoonyLearn and the site.

Adults

With regard to parents, teachers, or other adults who have provided information in connection with a paid subscription to the site, we may disclose such information, including Personal Information, with your consent, as otherwise described in this Privacy Policy, and in the following limited circumstances:

Other Third Party Service Providers. In addition to those third-party service providers described above, we may provide information collected from adult users of the site to other service providers performing services on behalf of the Site, such as processing transactions and sending email or other communications. We may provide these service providers with access to your Personal Information so that they can carry out the services they are performing for you or for LoonyLearn. In some instances, you may provide your Personal Information directly to an identified third party through a widget or other third party-hosted feature on the site, such as when providing payment information during the checkout process for a subscription account. When providing information directly to a third-party service provider through such a feature, the information may be subject to the privacy practices and policies of that service provider, but any information we receive will be subject to this policy.

Administrative or Legal Reasons. We may also transfer and disclose information, including Personal Information, to third parties: (i) in the event we are required to respond to subpoenas or other legal process or if in our opinion such disclosure is required by law; (ii) at the request of governmental authorities conducting an investigation; or (iii) to protect and/or defend policies applicable to the site or to protect the safety, rights, property or security of LoonyLearn.com or any other individual or entity.

Business Transfers. We may also disclose and transfer your information, including Personal Information: (i) to a subsequent owner, co-owner or operator of the site or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of certain of LoonyLearn’s ownership interests, assets, or both, or other corporate change, including, without limitation, during the course of any due diligence process.

 

THIRD PARTY ANALYTICS PROVIDERS AND AD SERVERS

LoonyLearn works with network advertisers, ad agencies, third party traffic measurement services and other service providers to serve advertisements on the site and to provide us with information regarding traffic on the site, including the pages viewed and the actions users take when visiting the site and to serve our advertisements on other web sites and elsewhere online. Our service providers may set and access their own tracking technologies on your device (including cookies and web beacons) and may collect or have access to your Device Identifier and Usage Information, provided that your Device Identifier and will be used only to support internal operations. We may share Usage Information about visitors with third party advertising companies, analytics providers and other vendors for similar purposes.

LINKS TO OTHER SITES

Certain content on the site may be hosted and served by third parties. In addition, the Site may contain links to third party web sites that LoonyLearn.com does not control. We are not responsible for the privacy or data collection practices of any third party.

PARENT’S AND TEACHER’S RIGHTS

Parents and Teachers have the right to review and request that LoonyLearn delete any Personal Information that the site has collected and retained about their child. If you would like to request that LoonyLearn delete any Personal Information LoonyLearn may have about your child (such as first name, last name and contact information prior to the site’s one-time use) or if you would like to request that the site make no further collection of Personal Information about your child, please contact LoonyLearn as described in the “Contact Us” section.

CONSENT TO TRANSFER

If you are located outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the site, or providing us with any information, you fully understand and unambiguously consent to the collection, transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

SECURITY

LoonyLearn has established and maintains reasonable procedures to protect the confidentiality, security, and integrity of Personal Information collected from users of the site. We also take reasonable steps to release Children’s Personal Information, if any, only to service providers and third parties who are capable of maintaining the confidentiality, security and integrity of such information, and who, as described above, have agreed that they will maintain the information in such a manner.

CHANGES TO OUR POLICY

LoonyLearn may update this Privacy Policy at any time and any changes will be effective upon posting (unless otherwise specified). If we make any material changes in the way we use your Personal Information, we will update the “Effective Date" above and we will display a notice on the site. We may also provide notice to you in other ways in our discretion. Your continued use of the site after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes. However, we will obtain parental consent prior to using or disclosing Personal Information in a manner materially different from the Privacy Policy posted at the time of collection and any prior parental consent received.
